Illinois Strengthens Trans Protections After Trump Reelection

In the wake of President-elect Donald Trump's reelection, Illinois lawmakers and advocates are urgently strengthening state protections for transgender individuals. Facing potential federal rollbacks on trans rights, the state is enhancing medical data privacy, healthcare access, and anti-discrimination laws to ensure safety and support for the transgender community.

As the nation grapples with the implications of President-elect Donald Trump’s reelection, transgender individuals and their allies are facing a resurgence of anxiety and uncertainty. In Illinois, a state that has long been a haven for LGBTQ+ rights, advocates and lawmakers are mobilizing to fortify existing protections and prepare for potential federal challenges that could undermine the rights of transgender people.

State Representative Kelly Cassidy, a vocal supporter of LGBTQ+ rights, has been at the forefront of this effort. “There’s a hole in that shield, and that’s data privacy, so that’s the top priority,” Cassidy stated, emphasizing the urgent need to address gaps in legislation that could expose transgender individuals to discrimination or legal repercussions. Governor J.B. Pritzker has been unwavering in his support. “This Transgender Awareness Week, I want you to know that I see you and have your back as governor,” Pritzker affirmed. “Illinois has enshrined protections for gender-affirming care to meet this moment—and because of that, you will have a home here always.” His administration is actively reviewing Project 2025—a conservative policy blueprint from the Heritage Foundation—and Trump’s policy proposals to identify areas where state laws can be fortified.

The Looming Threat of Federal Policies

Despite Illinois’ progressive stance, there is growing concern about how federal policies under a Trump administration could circumvent state protections. Agenda47, the Trump campaign’s outline for the next four years, and Project 2025 include proposals that could significantly impact the rights of transgender individuals. These plans suggest ending civil rights protections for LGBTQ+ people, removing doctors who provide gender-affirming care from Medicare and Medicaid coverage, and withholding funds from schools that protect the rights of transgender students.

“If a national ban on gender-affirming care passed, that’s our worst-case scenario,” Cassidy warned. “None of our laws will matter.” This sentiment echoes throughout the transgender community, where fears of losing access to essential healthcare and facing increased discrimination are palpable.

Camilla Taylor, litigation director at Lambda Legal, offers a cautiously optimistic view. She notes that previous Supreme Court decisions have established that withholding healthcare from transgender individuals based on their identity is unconstitutional. “Law enforcement elsewhere may be weaponized, and they may seek to conscript our law enforcement agencies to do things that are not lawful here in Illinois,” Taylor explained. “But we don’t see a lot of dramatic struggles because the laws are very clear.”

However, Taylor acknowledges that those most at risk are individuals who cannot afford to relocate or travel for care, and those who rely on telemedicine or receive medication through the mail. Cassidy is advocating for a $500 tax credit to assist people and healthcare providers forced to leave states with restrictive laws, but this proposal has yet to advance out of committee.

For many transgender individuals, the reelection of Donald Trump has prompted difficult decisions about their futures. Sage Worden, a 25-year-old transgender woman living in Wisconsin, is considering relocating to Illinois. “I don’t even have the money to move, but with Wisconsin going red and the amount of Trump signs I see, it doesn’t feel like it’s a safe place anymore,” Worden shared. “If it comes between finances or safety, I’m going to choose safety.”

Worden’s story is emblematic of the broader fears within the transgender community. The prospect of uprooting one’s life, leaving behind support networks, and facing financial uncertainty underscores the profound impact that political shifts can have on marginalized communities.

Community Solidarity and Support

Despite the challenges ahead, there is a strong sense of solidarity among advocates, lawmakers, and community members. Cassidy recalls the community response to ICE raids in 2020 as a source of inspiration. “We have to do the work to put those pieces back together and be there for each other,” she asserted. “I’m gonna be standing between ICE and my neighbors, and I know they’ll be standing between us and whatever comes for us.”

Ed Yohnka, director of communications and public policy for the ACLU of Illinois, emphasizes the importance of vigilance, especially in areas outside of Chicago. “This election may provide a permission structure for some to believe they can override the law of the state of Illinois and pick and choose which of those laws they follow because of the policy of the president,” Yohnka cautioned.

Governor Pritzker’s dedication to protecting transgender individuals is both personal and political. His cousin, Jennifer Pritzker, is a transgender woman and an outspoken advocate for transgender rights. Through the Tawani Foundation, Jennifer supports organizations that advance “gender and human sexuality” initiatives. This familial connection reinforces the governor’s resolve to ensure Illinois remains a sanctuary for transgender individuals.

Pritzker is not only focused on maintaining current protections but is also actively preparing for potential federal challenges. His administration is reviewing legal strategies to safeguard environmental policies, reproductive rights, and healthcare access. “Chaos, retribution, and disarray radiated from the White House the last time Donald Trump occupied it,” Pritzker remarked. “Perhaps this time may be different. But if it isn’t, Illinois will remain a place of stability and competent governance.”
